Common Questions

Frequently Asked Questions

What is a Living Will, and is it legally recognised in Malaysia?
A Living Will, or Advance Directive, is a written statement of your preferences regarding medical treatment in the event you are unable to communicate those wishes yourself. While Malaysia does not yet have specific legislation governing Advance Directives, such documents carry significant moral and practical weight in communications with medical professionals and family members. Our advisors explain the current legal standing clearly so you can make an informed decision about whether such a document serves your purposes.
How long does the trust establishment process typically take?
The duration varies depending on the complexity of the family's assets and the type of trust being established. A straightforward discretionary family trust can generally be structured over two to three advisory sessions and a period of two to four weeks for drafting and review. More complex arrangements — particularly those involving multiple asset classes or charitable components — take longer. We give you a realistic timeline at the outset of each engagement.
We have a parent who recently passed away with property in Singapore. How do we begin?
Foreign asset inheritance situations require prompt attention, as overseas probate timelines and procedures differ significantly from those in Malaysia. We recommend arranging a consultation as soon as you are able — ideally before you contact the foreign institution directly. We assess the relevant jurisdiction's requirements, advise on the documents you will need to gather, and coordinate with appropriate counsel in that country on your behalf.
Are your fees quoted inclusive of all associated charges?
The fee quoted for each service covers our professional time, advisory sessions, and document preparation. Where a matter involves disbursements — such as government registration fees, stamp duty, or overseas counsel coordination charges — these are communicated separately and transparently before any instruction is accepted. There are no unexpected charges added later.
Can we involve our existing family solicitor in the process?
Yes, we are comfortable working alongside other legal advisors where a family has an existing professional relationship. We often find that clear communication between the respective advisors benefits the family and avoids duplication of effort. Please let us know about any existing advisory relationships at the start of your consultation.
Is it possible to hold appointments outside of regular office hours?
We understand that families dealing with estate matters are often managing many other responsibilities. Appointments in the early evening on weekdays are available by arrangement. Please mention your scheduling preferences when you contact us and we will do our best to accommodate.
